What makes a great expert witness?



An expert that has hundreds of hours of instructing and teaching can turn the courtroom into his/her classroom. I have always enjoyed instructing.  But find that I really enjoy looking around the courtroom and watching everyone in there, sort of slow down and ‘become’ a student.  I set my speaking cadence as I do with my students, talk to the level of the jury and monitor their facial expressions and body language, explain the topics I have been hired for, in such a way that there are few, if no questions. 


An expert that knows and speaks regarding their specialty topic(s) so thoroughly, you get to watch opposing counsel have to confer with each other (more than once) before asking you any questions. To me it shows that I’ve got opposing counsel ‘cornered’ and that they will want me off the stand quick! 


An expert that is so in tune with their team that they can pick up on subtle body language to, hit a certain point harder, elaborate or move off an issue etc. I have always made it a point to assimilate. You have hired me to be on your team, it is my position to have you immediately know you’ve made a good decision and to become an asset.


An expert that doesn’t get ‘rattled’ or defensive. I have learned that if you concentrate more on ‘out working them instead of outsmarting them’, you’ll win. With solid knowledge, review, prep time you’ll own the room.


An expert that gets certified to testify in court as an expert witness, by the Judge after about 5 mins of starting in with his/ her credentials. My last case in District court, I was certified just by my submitted C.V. alone. There was nothing to dispute or question regarding my credentials and all parties agreed or submitted. 


An expert that provides you with a solid report that will assist in making the opposing counsel want to settle! A report and a C.V. that has them rubbing their foreheads, stress sweating and maybe even cursing, just a little.


So, when hiring an expert, make sure they hit all the highs. You don’t have time or money to waste. The good fight continues.
