Just wrapped up sitting as an advisory witness and Use of Force Expert for a case involving self defense. This case involved a person that was assaulted by their domestic partner.
During the assault the victim in this case used taught self-defense techniques to defend themselves. 911 was called, by the victim.
Responding deputies conducted and "investigation" as to who was going to be arrested. The deputies used terms like 'predominate aggressor' and 'flip of the coin' as deciding factors!
The deputies decided to arrest the victim for the assault with a domestic violence enhancer because a common part of the incident was that the victim pushed the 'attacker' away.
I was easily able to relate to the jury and could tell that they wanted to hear my testimony (2 hours worth). I explained that 'predominate aggressor' (defined) is NOT a thing and that what IS used is 'primary aggressor' (also defined). I explained that 'probable cause' (defined) is NEVER decided by a 'flip of the coin!'
It was also my pleasure to educate the jury in use of force and the reasonableness standard. I also was able to educate the jury in self defense (UoF) that includes 'proportionate' in response and non-retaliatory.
Worked with a fantastic law firm (not sure if they would want a plug or not so name withheld), great lawyers and legal assistance personnel.
End result- Not guilty on ALL charges.
